§ 1 Scope of Application
(1) These General Terms and Conditions (hereinafter “GTC”) apply to all contracts, services, and offers between Curry One GmbH (hereinafter “BEAST Berlin”) and its customers regarding the use of the website https://beast-berlin.com/, table reservations, the purchase of vouchers, and the booking of event tickets.
(2) Deviating terms and conditions of the customer shall not be recognized unless BEAST Berlin expressly agrees to their validity in writing.
§ 2 Use of the Website
Content (texts, menus, photos) on https://beast-berlin.com/ is subject to copyright. BEAST Berlin strives to ensure high website availability but does not guarantee uninterrupted access.
§ 3 Table Reservations and Cancellation
(1) Reservations become binding only upon confirmation by BEAST Berlin (usually via email).
(2) Cancellations must be made no later than 24 hours prior to the scheduled time. If the guest fails to appear without timely cancellation (no-show), BEAST Berlin reserves the right to charge a cancellation fee.
§ 4 Vouchers (Special Provisions)
(1) Exclusive Scope: Restaurant vouchers are valid exclusively for a regular visit during standard restaurant operations (food and beverages from the regular menu).
(2) Exclusion of Special Events: Restaurant vouchers are expressly NOT redeemable for special events, shows, themed evenings, or so-called “Dinner Nights” (e.g., Dinner Show Nights, Circus of Taste, New Year’s Eve Gala, Sparkling Brunch). Separate event tickets apply exclusively to these occasions.
(3) Vouchers are subject to the statutory limitation period of three (3) years. Cash redemption is excluded.
§ 5 Tickets for Special Events and Dinner Nights
(1) BEAST Berlin provides separate event tickets for special events and dinner nights.
(2) No right of withdrawal for event tickets: Pursuant to § 312g para. 2 no. 9 of the German Civil Code (BGB), there is no right of withdrawal for contracts concerning scheduled leisure events. The exchange or return of ticket bookings is excluded.
§ 6 Prices & Payment Terms
All prices are quoted in euros (€) and include statutory VAT. Online payments are processed via the payment service providers offered during the ordering process.
§ 7 Right of Withdrawal for Online Voucher Purchases
Consumers have a 14-day right of withdrawal when purchasing vouchers online, provided the voucher has not yet been redeemed within that period.
§ 8 Liability
BEAST Berlin accepts unlimited liability in cases of willful misconduct, gross negligence, and injury to life, body, or health. In the event of a breach of essential contractual obligations due to simple negligence, liability is limited to foreseeable damage typical of the contract.
§ 9 House Rules
Instructions given by service staff must be followed. BEAST Berlin reserves the right to deny entry to individuals who disrupt operations or are heavily intoxicated.
§ 10 Data Protection & Dispute Resolution
(1) Data processing is carried out in compliance with the GDPR.
(2) The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. BEAST Berlin is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Final Provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction for commercial customers is Berlin.
